Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

User Submitted Content

9IELTS users may post, upload, and/or contribute (“post”) content to the Service (which may include, for example, pictures, text, messages, information, playlist compilations, and/or other types of content) (“User Content”). For the avoidance of doubt, “User Content” includes any such content posted to the 9IELTS Support Community as well as any other part of the 9IELTS Service.

You promise that, with respect to any User Content you post on 9IELTS, (1) you have the right to post such User Content, and (2) such User Content, or its use by 9IELTS as contemplated by the Agreements, does not violate the Agreements, applicable law, or the intellectual property (including without limitation copyright), publicity, personality, or other rights of others or imply any affiliation with or endorsement of you or your User Content by 9IELTS or any artist, brand, label, entity or individual without the express written consent from such individual or entity.

9IELTS may, but has no obligation to monitor, review, or edit User Content. In all cases, 9IELTS reserves the right to remove or disable access to any User Content for any or no reason, including but not limited to User Content that, in 9IELTS’ sole discretion, violates the Agreements. 9IELTS may take these actions without prior notification to you or any third party. Removal or disabling of access to User Content shall be at our sole discretion, and we do not promise to remove or disable access to any specific User Content.

You are solely responsible for all User Content that you post. 9IELTS is not responsible for User Content, nor does it endorse any opinion in any User Content. YOU AGREE THAT IF ANYONE BRINGS A CLAIM AGAINST 9IELTS RELATED TO USER CONTENT THAT YOU POST, THEN, TO THE EXTENT PERMISSIBLE UNDER LOCAL LAW, YOU WILL INDEMNIFY AND HOLD 9IELTS HARMLESS FROM AND AGAINST ALL DAMAGES, LOSSES, AND EXPENSES OF ANY KIND (INCLUDING REASONABLE ATTORNEY FEES AND COSTS) ARISING OUT OF SUCH CLAIM.

Takedown requests

9ielts.com complies with 17 US Code § 512 and the Digital Millennium Copyright Act (“DMCA”). Our policy is to respond to infringement notices and take appropriate actions under the Digital Millennium Copyright Act (“DMCA”) and other applicable intellectual property laws. You may submit a takedown request if you become aware of user content on 9IELTS that infringes your copyright rights. We will respond to legitimate takedown requests and retain the right to remove user content on the website that we deem to be infringing the copyright of others.

The following elements must be included in your copyright infringement claim:

  • Provide evidence of the authorized person acting on behalf of the owner of an exclusive right allegedly infringed.
  • Provide sufficient contact information so that we may contact you. You must also include a valid email address.
  • You must identify in sufficient detail the copyrighted work claimed to have been infringed and include at least one search term under which the material appears in our search results.
  • A statement that the complaining party has a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notification is accurate and under penalty of perjury that the complaining party is authorized to act on behalf of the owner of an exclusive right allegedly infringed.
